Responsibility in Case of Technical Errors
When conducting transactions on the DauThau.Net e-commerce platform, members must follow the prescribed procedures correctly.
The management board of the DauThau.Net e-commerce platform commits to providing the best quality service to participating members, striving to ensure the safety and stability of the entire technical system.
However, in case of technical errors beyond the control of DauThau.Net, immediate measures will be applied to protect members' rights. In case of technical errors, software errors, or other objective errors leading to members being unable to participate in transactions, members should notify the management board of the DauThau.Net e-commerce platform via the email address
[email protected] DauThau.Net will rectify the error as soon as possible, facilitating members' participation in the DauThau.Net e-commerce platform. The DauThau.Net e-commerce platform will not be responsible for resolving cases where members' notifications fail to reach the management board due to technical errors, transmission errors, software or other errors not caused by the management board.
Rights and Responsibilities of DauThau.Net E-commerce Website Management
Register to establish a website providing e-commerce platform services as prescribed in Section 2, Chapter IV of Decree 52/2013/ND-CP and publish information about the website owner as regulated in Article 29 of Decree 52/2013/ND-CP on the homepage of the website.
Develop and publicly publish on the website the operating regulations of the e-commerce platform as regulated in Article 38 of Decree 52/2013/ND-CP; monitor and ensure the implementation of these regulations on the e-commerce platform.
Require sellers on the e-commerce platform to provide information as regulated in Article 29 of Decree 52/2013/ND-CP when registering to use the service. For foreign sellers, individual names are transliterated into Vietnamese or represented in Latin characters.
Have a mechanism to check and supervise to ensure that the information provided by sellers on the e-commerce platform is accurate and complete.
Store registration information of traders, organizations, and individuals participating in the e-commerce platform and regularly update related changes and additions.
Apply necessary measures to ensure the safety of information related to business secrets of traders, organizations, individuals and personal information of consumers.
Take timely measures when detecting or receiving reports of business activities violating the law on the e-commerce platform:
- Prevent and remove from the website information about the sale of goods, provision of services that fall into the category of goods and services banned from business, belonging to industries and trades banned from investment and business as prescribed by law;
- Remove information about goods and services violating the law within 24 hours from the time of receiving a request from the competent state management agency;
- Coordinate with intellectual property rights holders to review and remove infringing products as per the procedure and process published in the Operating Regulations of the e-commerce platform;
- Warn or refuse to provide services for a fixed term or permanently to individuals, traders, organizations with business activities violating the law;
- Other measures according to the Operating Regulations of the e-commerce platform.
Support state management agencies in investigating, handling business activities violating the law and resolving disputes and complaints.
- Provide information about subjects showing signs of, or engaging in, illegal activities on the e-commerce platform to the competent state management agency when detecting or receiving the above information;
- Regularly update keywords as recommended by the competent state management agency and filter information by keywords before information about goods and services is displayed on the website;
- Receive, respond to information to resolve complaints, reports, and disputes related to the e-commerce platform at the E-commerce Activities Management Portal of the Ministry of Industry and Trade at online.gov.vn.
Publicly disclose mechanisms for resolving disputes arising during transactions on the e-commerce platform. When customers on the e-commerce platform have conflicts with sellers or suffer legitimate interests damage, they must provide customers with information about the seller and actively assist customers in protecting their legitimate rights and interests.
Maintain the normal operation of the DauThau.Net e-commerce platform and promptly rectify any incidents affecting the operation of the platform such as: technical problems with machinery, software errors, internet transmission system, personnel, social fluctuations, natural disasters, power outages, decisions of state agencies or a related third party organization. In the event of force majeure events such as: natural disasters, fires, social fluctuations, decisions of competent authorities... beyond control, the DauThau.Net e-commerce platform is not responsible.
Rights and Responsibilities of General Members on DauThau.Net Website
Upon registering to become a member of DauThau.Net and being approved by DauThau.Net, members will be created an account to participate and enjoy the privileges within the system of DauThau.Net. Members will be given a unique registration name and password to access services, manage their account and information about their history of using privileges in the DauThau.Net system.
Members will be able to enjoy the preferential policies provided by DauThau.Net or third-party partners on DauThau.Net. These preferential policies will be resolved by DauThau.Net (if any) and will be directly posted on DauThau.Net or sent directly to the members.
Members have the right to introduce promotional programs on the website with full information including: name, address, phone number, and other contact information of the member, description of goods and services being promoted and goods and services used for promotion, promotional time, start date, end date, and promotional operation area; specific content of conditions associated with the promotion of goods and services. DauThau.net members have the right to contribute opinions to DauThau.Net during its operation. Suggestions are sent directly by mail or email to DauThau.Net.
Members are responsible for securing, storing, and all activities using the service under their registration name, password, and email box. Members are responsible for promptly notifying DauThau.Net of any unauthorized use, abuse, security violation, storage of their registration name and password so that both parties can cooperate in handling.
Rights and Responsibilities of Contractors on DauThau.Net Website
Have the right to contribute opinions by letter, email, or phone call to the DauThau.Net e-commerce platform during its operation.
Have the responsibility to provide complete and accurate information including the name and head office address of the trader, organization, or name and permanent address of the individual; number, date of issue, and place of issue of the trader's business registration certificate, or number, date of issue, and issuing unit of the organization's establishment decision, or personal tax identification number; phone number or another online contact method.
Bear full responsibility for issues related to the copyright of content, images, information provided and must ensure to provide complete information as regulated from Article 30 to Article 34 of Decree 52/2013/ND-CP and be responsible for the accuracy and truthfulness of the tender/bidding information posted on DauThau.Net.
Contractors must comply with and implement the regulations of the law on posted information when conducting transactions on DauThau.Net as specifically regulated in Section 2, Chapter II of Decree 52/2013/ND-CP;
Contractors must comply with the law on payment, advertising, promotion, protection of intellectual property rights, protection of consumer rights, and other relevant legal regulations when selling goods or providing services on the e-commerce platform and fully fulfill tax obligations as prescribed by law.
Contractors have the responsibility to provide transaction information to support the DauThau.Net e-commerce platform in resolving disputes arising between Contractors and Bid Solicitors.
Contractors have the responsibility to compensate the Bid Solicitors if it can be proven that the error belongs to the Contractors.
Fulfill tax obligations as prescribed by law.
Rights and Responsibilities of Bid Solicitors on DauThau.Net Website
Have the right to post tender/bidding information on DauThau.Net, after registering to become a Bid Solicitor and being approved by DauThau.Net.
Have the right to contribute opinions by letter, email, or phone call to the DauThau.Net e-commerce platform during its operation.
Have the responsibility to provide complete and accurate information including the name and head office address of the trader, organization, or name and permanent address of the individual; number, date of issue, and place of issue of the trader's business registration certificate, or number, date of issue, and issuing unit of the organization's establishment decision, or personal tax identification number; phone number or another online contact method.
Bear full responsibility for issues related to the copyright of content, images, information provided and must ensure to provide complete information as regulated from Article 30 to Article 34 of Decree 52/2013/ND-CP and be responsible for the accuracy and truthfulness of the tender information posted on DauThau.Net.

Bid Solicitors must comply with the law on payment, advertising, promotion, protection of intellectual property rights, protection of consumer rights, and other relevant legal regulations when selling goods or providing services on the e-commerce platform and fully fulfill tax obligations as prescribed by law.
Bid Solicitors have the responsibility to provide transaction information to support the DauThau.Net e-commerce platform in resolving disputes arising between Bid Solicitors and Contractors.
Bid Solicitors have the responsibility to compensate the Contractors if it can be proven that the error belongs to the Bid Solicitors.
Fulfill tax obligations as prescribed by law.
Applicable Terms
The content herein is effective from 12/2020, immediately upon being published on the website www.dauthau.net for all members, individuals, and organizations participating.
DauThau.Net reserves the right to modify and supplement the contents of these regulations to suit the business activities of the Company and the operation of the DauThau.Net e-commerce platform. When that occurs, the management board will publicly announce the content change on the website. The amended regulations will be effective after 05 (five) days from the date the modification announcement is published.
Members participating in transactions on the DauThau.Nete-commerce website are responsible for adhering to the current regulations.
DauThau.Net is not responsible for direct transactions between buyers and sellers. In reality, when buyers and sellers connect through DauThau.Net, all subsequent contact, exchange, and transaction activities do not need to be conducted on the platform. In other words, DauThau.Net's main role is to connect buyers with sellers, not to be a place for direct transactions between them.
